Case Dismissed Over Procedural Issues
A federal judge in New York on Wednesday dismissed a lawsuit filed against music mogul Sean “Diddy” Combs. The plaintiff, who at the time of filing was an anonymous somebody, said that he was sexually assaulted by Combs at a 2022 house party. The judge dismissed the case because the plaintiff did not have court clearance to file anonymously.
The anonymous plaintiff, who is a resident of Georgia, alleged that the incident occurred at a house party in New York. He claimed he was given an alcoholic drink that left him disoriented and eventually unconscious. According to the plaintiff, when he regained consciousness, he was in a dark room with black walls, with Combs allegedly on top of him.
The lawsuit described the situation as horrifying and said the plaintiff felt violated and traumatized. In similar patterns described by other anonymous accusers who have filed lawsuits against Combs, represented by Houston-based personal injury attorney Tony Buzbee.
Court dismisses case on grounds of filing based on anonymity
The judge dismissed the case on procedural grounds citing that the plaintiff had not sought leave to file as “John Doe.” According to court procedures, all such cases need prior leave before being allowed to proceed under pseudonyms.
The court buttressed this by pointing out that any anonymous procedure must be initiated as a miscellaneous case, requesting express leave from the court. This procedural blunder was why the case was dismissed.
A String of Allegations Against Combs
The dismissal is among several legal cases filed against Combs, many of which feature anonymous plaintiffs. Just recently, more allegations appeared against Combs as several others chimed in to make new claims-an assault during a 2004 party in the Hamptons; another by an aspiring actor in the late 1990s.
In one case, the male plaintiff alleged that Combs drugged his drink during an audition for a video shoot and that he became unconscious. He claimed that he later was conscious when he noticed Combs at him through his distinctive chest tattoo and gold chain. A second plaintiff alleged she was 17 years old when Combs and his bodyguards beat her up at a Fourth of July celebration.
Counterclaims and Legal Pushback
Combs‘ attorneys dismissed the claims as baseless and labeled the lawsuits “shameless publicity stunts.” They have also accused Buzbee of filing these cases as part of an extortion campaign targeting high-profile celebrities.
In response to the acquittal, Combs’ lawyers issued a statement declaring that their client was innocent. “Mr. Combs has full confidence in the facts and the integrity of the judicial process. The truth will prevail: Mr. Combs never sexually assaulted or trafficked anyone — man or woman, adult or minor,” the statement read.
A Case That Escalates
The sexual assault allegations against Combs come amidst broader legal challenges. Buzbee himself is now the target of a lawsuit from an individual linked to Combs, accusing the attorney of extortion. Combs’ legal team argues that Buzbee’s approach exploits celebrities’ reputations for financial gain.
Even though the current case dismissal may present victory for Combs, lawsuits remain on court records, and the story of the music mogul is far from over as accusers continue to file claims which increase the controversy.
